2007-2008 firm Certificates of Authorization will expire Friday, June 30, 2008

The Board has mailed 2008-2009 firm Certificate of Authorization renewal reminders. Certificates of Authorization to provide engineering and surveying services in the state of Ohio expire each year on June 30. To renew, a renewal application must be downloaded from our website. Please note that the renewal form requires your firm's 5-digit Certificate of Authorization license number which you can find in the lower right corner of your renewal letter, on your current license, or from the License lookup page.

While you can complete the renewal application online, you will need to print the application and mail it with a $25.00 fee made payable to Treasurer, State of Ohio. Mail the renewal application to the address on the application.

IMPORTANT! Your Certificate of Authorization will will expire and become inactive if the annual renewal filing has not been received by the Board on the close of business on June 30, 2008.

REMINDER…Ohio Revised Code Chapter 4733 requires that your firm Certificate of Authorization application have an ACTIVE Ohio Secretary of State charter or registration number. You can search Ohio's Secretary of State website to find your firm's number.

From the Ohio Secretary of State website:

"Anyone who is planning to do business within the State of Ohio, using a name other than their own personal name, must register with our office. Sole Proprietorships are not required to register with the Secretary of State's office. This applies to companies in Ohio and companies in other states or countries wishing to do business in the State of Ohio. Companies outside the State of Ohio often have to include a Certificate of Good Standing from their home state's Secretary of State or registering authority to accompany their filing."

Overview

Any firm providing, or offering to provide, Professional Engineering or Professional Surveying services in the state of Ohio needs a Certificate of Authorization from the State Board of Registration for Professional Engineers and Surveyors. You can find the legal requirements in Ohio Revised Code [R.C.] section 4733.16 and Ohio Administrative Code [A.C.] section 4733-39.


New applications

IMPORTANT! The new application form has major revisions. The Board will only accept PES 3011-N (Rev. 05/2008) for new Certificate of Authorization applications. Older application forms received for a new application will be returned.

Contact Ohio's Secretary of State for your Ohio business charter/registration number, which is required on your application.

2004 law change reminder

Effective May 15, 2004, Ohio R.C. section 4733.16 reads in part: "Each firm, partnership, association, limited liability company, or corporation through which professional engineering or professional surveying services are offered or provided in this state shall designate one or more full-time partners, managers, members, officers, or directors as being responsible for and in responsible charge of the professional engineering or professional surveying activities and decisions, and those designated persons shall be registered in this state."

The 2004 law update introduced two major changes.

1 The Ohio P.E. or Ohio P.S. designated in responsible charge of engineering or surveying services must sign the application and be a full time employee — minimum 30 hours a week — of the firm applying for the Certificate of Authorization.

2 A corporation applying for a Certificate of Authorization no longer needs the Ohio P.E. or Ohio P.S. designated in responsible charge to be on the corporate board of directors.
